These Terms of Use (“Terms of Use”) are effective as of May 30, 2023.

DesignFuture SAS (Material Bank) (“MB”, “we”, “us”, or “our”), operates the website materialbank.eu and related apps, portals and tools (collectively, the “Platform”) that allow material specifiers to perform complex searches across many manufacturers to request and receive physical samples of materials of interest (each, a “Sample”) and related services and tools to streamline the design process (the “Services”). As used herein, “Manufacturer” refers to a manufacturer or supplier of a material sample visible on the Platform. “Visitor” refers to a person who visits or views any part of the Platform, whether or not they have registered. “Member” refers to a person who submitted an application and registered to use the Platform or Services, even if the person does not use the Platform or Services to place an order for Samples. “User,” “You” or “Your” may refer to a Visitor or a Member.

Please read these Terms of Use carefully as they form a legal agreement between you and MB. These Terms of Use cover important information about the Platform and the Services, including, any charges, taxes, and fees MB bills you. These Terms of Use include information about future modifications, export controls, automatic renewals, limitations of liability, and a resolution of disputes by mediation.

By visiting the Platform, submitting a registration application to become a Member, or otherwise using the Services, you agree to be bound by these terms of use and the following policies:

The Platform and Services are intended only for use in the European Economic Area, the United Kingdom, and Switzerland (the “Territory”) and are not directed to, or intended to be used by, persons or entities operating outside of the Territory. If you are located in the United States or Canada, please visit materialbank.com.

1. Eligibility

MB is designed and reserved for members of the architecture and design community and is limited to members of architecture and design firms and to Manufacturers’ representatives. Additionally, MB is intended only for Members within the Territory. If you are operating outside of the Territory, you are not authorized to use the Platform or Services. Registration for the Platform and Services is void where prohibited.

MB shall have the right to decide in its sole discretion, based upon the information that you provide, whether to accept you as a Member. Acceptance may occur immediately or take up to several days depending on whether you are a commercial or residential designer, a Manufacturer representative, a student or educator, and other relevant factors. You acknowledge and agree that you are not guaranteed to be accepted as a Member and your application may be rejected by MB in its sole discretion for any reason.
